The Competition Commission is closely monitoring Nestle Hellas. In detail, the Independent Authority issued yesterday at noon an announcement according to which it carried out on 17 and 18 December an unannounced on-site inspection as part of an ex-officio investigation into a company active in the supply, marketing, wholesale and retail markets for coffee, chocolate and baby food.

THE REASON FOR THE INVESTIGATION

The reason for the investigation by the Authority is possible anti-competitive horizontal and/or vertical cartels and possible abuse of a dominant position, in violation of Articles 1 and 2 of Law No. 3959/2011, as amended, and Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU).

As the Authority explains, the inspections are carried out on undertakings or associations of undertakings from which evidence of anti-competitive practices in the investigated markets can be collected and do not prejudge that the undertakings have engaged in anti-competitive behavior, nor does it prejudge the outcome of the investigation.

"The EA, the guardian of the proper functioning of the free market, is charged with the enforcement of competition rules under Art. 3959/2011 and Articles 101/102 TFEU.

  • Articles 1 of Law No. 3959/2011 and 101 TFEU prohibit agreements between undertakings (agreements, decisions by associations or concerted practices) that have as their object or effect the restriction of competition.
  • Article 1A of Law No. 3959/2011 prohibits unilateral practices that constitute an invitation to a prohibited cartel and announcements of future pricing intentions for products and services to competitors.
  • Articles 2 of Law No. 3959/2011 and 102 TFEU prohibit abusive conduct by undertakings with a dominant position on the market," the EA's statement said.
